East Grand Forks<\/strong> (trfnews.i234.me<\/a>) \u2014 An East Grand Forks man is facing three charges in Polk County District Court.<\/p>\n

Benjamin Ryan Leonard Bayliss, 32, is charged with third-degree DWI test refusal.<\/p>\n

He is also charged with fourth-degree DWI and obstructing legal process.<\/p>\n

The case was filed in Minnesota\u2019s Ninth Judicial District.<\/p>\n

The court file number is 60-CR-26-501.<\/p>\n

Police First Called To Home<\/h2>\n

According to the complaint, police were called on April 16, 2026.<\/p>\n

The call involved a reported dispute between a mother and adult son.<\/p>\n

Officers spoke with Bayliss at the home.<\/p>\n

The complaint says officers believed he showed signs of intoxication.<\/p>\n

Officers offered Bayliss a ride to a hotel several times.<\/p>\n

They also told him not to drive that morning.<\/p>\n

The complaint says officers then left the home.<\/p>\n

An officer stayed nearby due to concern that Bayliss may drive.<\/p>\n

Traffic Stop On Bygland Road<\/h2>\n

About 30 minutes later, police saw a man enter a black Subaru Outback.<\/p>\n

The complaint says the vehicle was registered to Bayliss.<\/p>\n

Police later identified Bayliss as the driver.<\/p>\n

Authorities reported that the vehicle did not stop behind a marked stop line.<\/p>\n

A traffic stop was made in the 300 block of Bygland Road SE.<\/p>\n

Complaint Says Breath Test Was Refused<\/h2>\n

During the stop, officers reported a strong odor of alcohol.<\/p>\n

The complaint says Bayliss had watery and bloodshot eyes.<\/p>\n

Police asked Bayliss to complete field sobriety testing.<\/p>\n

The complaint says he had trouble following directions.<\/p>\n

Authorities also reported signs of impairment during testing.<\/p>\n

Bayliss was placed under arrest.<\/p>\n

The complaint says he became combative and did not follow commands.<\/p>\n

Police later read the breath test advisory to Bayliss.<\/p>\n

Bayliss asked to contact an attorney, according to court records.<\/p>\n

The complaint says he later refused a breath test.<\/p>\n

Charges Filed In Polk County<\/h2>\n

Bayliss is charged under Minnesota Statute 169A.20<\/a>.<\/p>\n

The third-degree DWI refusal charge references Minnesota Statute 169A.26<\/a>.<\/p>\n

The obstruction charge falls under Minnesota Statute 609.50<\/a>.<\/p>\n

The most serious count carries up to 364 days in jail.<\/p>\n

It also carries a possible $3,000 fine.<\/p>\n
