A declaration of probable cause was filed on April 13 in Grand Forks County District Court.<\/p>\n<h2>What Police Say Happened<\/h2>\n<p>Police say King was driving a black 2009 Ford Edge east on 40th Avenue South. The vehicle was clocked at 48 mph in a 25 mph zone.<\/p>\n<p>Investigators say King then turned off his headlights. He also drove through the four-way stop at 40th Avenue South and Cherry Street without slowing down.<\/p>\n<p>Police activated emergency lights and followed the SUV. The vehicle later stopped in the 4100 block of Cottonwood Street.<\/p>\n<p>When officers approached, they reported signs of impairment. Court documents describe slurred speech, watery eyes, and an unsteady walk. Officers also reported smelling alcohol. She showed police a photo of King\u2019s SUV. Officers reported paint transfer on both vehicles. A crash report was then started.<\/p>\n<p>King\u2019s passenger also gave a statement to police. He said King picked him up from <a href=\"https:\/\/www.altru.org\/our-locations\/altru-hospital\" target=\"_blank\" rel=\"noopener noreferrer\">Altru Hospital<\/a>. He told officers King did not seem fit to drive. He also said he feared someone could get hurt.<\/p>\n<p>The passenger said the duster canister had been full earlier. He said it was empty when he got it back at the scene.<\/p>\n<h2>Arrest and Refusal<\/h2>\n<p>Police say King refused field sobriety testing. He was then arrested on suspicion of driving under the influence.<\/p>\n<p>After officers read North Dakota\u2019s implied consent advisory, King refused a chemical test, according to court documents. More information on that law is available through the <a href=\"https:\/\/ndlegis.gov\/cencode\/t39c20.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">North Dakota Century Code<\/a>.<\/p>\n<p>Authorities say King was booked into the <a href=\"https:\/\/www.gfcounty.nd.gov\/government\/gfso\" target=\"_blank\" rel=\"noopener noreferrer\">Grand Forks County Correctional Center<\/a>.
