Polk County<\/strong> (trfnews.i234.me<\/a>) \u2014 A Bagley man is facing four felony charges after a reported overnight break-in at Northern Kustomz in Erskine, according to a criminal complaint filed in Polk County District Court.<\/p>\n

Prosecutors charged Shawn Patric Smith, 18<\/strong>, with first-degree burglary of an occupied dwelling, third-degree burglary, threats of violence, and unauthorized use of a motor vehicle.<\/p>\n

What The Complaint Says<\/h2>\n

According to the complaint, the case began on June 28, 2025. A report came in about a stolen vehicle at Northern Kustomz in Erskine. Court records say the business also includes a living area occupied by B.H.<\/p>\n

The complaint says K.H.\u2019s vehicle, a 2014 Subaru Legacy<\/strong>, was taken from the property. The vehicle is registered to E.J. The complaint also says a pickup truck was left behind outside the business.<\/p>\n

Inside that truck, investigators reported finding property connected to B.H. The complaint says items included a picture frame with K.H.\u2019s name, a coffee shop point-of-sale system, and debit cards.<\/p>\n

Court records also allege food inside the shop had been eaten. Keys were moved from a box and placed in other areas. A dirt bike was also reported taken from inside the building.<\/p>\n

The complaint says Smith had prior contact with K.H. years earlier. It also says he sent Instagram messages and a photo of Doc Marten shoes that were later found outside the residence door.<\/p>\n

Threat Allegation And Vehicle Claim<\/h2>\n

The complaint further alleges Smith threatened K.H. during a phone call. Court records say he told her, \u201cyou are dead tonight.\u201d That statement led to the threats of violence charge.<\/p>\n

Smith is also accused of taking or driving the Subaru without permission. Investigators later located the Subaru in Bagley, according to the complaint.<\/p>\n

The court filing also states a white Ford pickup left at the scene had been reported stolen from a campground in Clearwater County.<\/p>\n

Charges Filed<\/h2>\n

The most serious count is first-degree burglary<\/a>. That charge carries a maximum sentence of 20 years in prison.<\/p>\n

The complaint also cites threats of violence<\/a> and unauthorized use of a motor vehicle<\/a> under Minnesota law.<\/p>\n

As in all criminal cases, the charges are allegations. Smith is presumed innocent unless proven guilty in court.<\/p>\n
