Fargo (trfnews.i234.me<\/a>)<\/strong> \u2014 A Fargo man is facing felony and misdemeanor charges after a disturbance call early on December 5.<\/p>\n

Disturbance Call on Westrac Drive South<\/h2>\n

According to court documents, officers were sent to 3361 Westrac Drive South around 5:50 a.m. for a reported disturbance.<\/p>\n

A woman told officers that she lived in the apartment and that 39-year-old Bret Sandy was inside without her permission.<\/p>\n

She said Sandy did not live there and had hit her before officers arrived at the building that morning.<\/p>\n

Documents say officers then found Sandy inside an elevator on the first floor of the building.<\/p>\n

When officers asked why he was there, Sandy said his girlfriend in a nearby building was \u201cbeing killed.\u201d<\/p>\n

Struggle During Attempted Arrest<\/h2>\n

Officers say Sandy tried to leave the area while they spoke with him in the hallway near the elevator.<\/p>\n

When officers moved to stop him, Sandy started swinging his arms and resisted their efforts to detain him.<\/p>\n

Documents say he punched one officer in the face with a closed fist during the struggle.<\/p>\n

Officers took Sandy to the ground by using his jacket, but he kept trying to roll and stand back up.<\/p>\n

Injuries and Medical Treatment<\/h2>\n

After what documents describe as a long struggle, officers were able to place Sandy in handcuffs on the floor.<\/p>\n

Once he was cuffed, an officer saw blood running down the face of the officer who had been struck.<\/p>\n

Court records say that the officer also had a visible injury to his lip after the punch to his face.<\/p>\n

Documents say Sandy later complained of shoulder and elbow pain from being handcuffed during the arrest.<\/p>\n

He was taken to Essentia Health in Fargo<\/a> for treatment of his reported injuries.<\/p>\n

The injured officer was also evaluated at Essentia for injuries related to the incident, according to documents.<\/p>\n

Charges and Upcoming Court Hearing<\/h2>\n

According to Cass County court records, Sandy is charged with simple assault on a peace officer and preventing arrest.<\/p>\n

Online records from the North Dakota Courts<\/a> show a preliminary hearing set for January 9.<\/p>\n

Further information about the incident may be released by the Fargo Police Department<\/a> as the case moves forward.<\/p>\n

All defendants are presumed innocent unless and until proven guilty in a court of law.<\/p>\n
