Court records say Shawn Robert Neustel<\/strong>, 49, of Verona, North Dakota, is charged.<\/p>\n

He faces a gross misdemeanor school bus stop arm violation count.<\/p>\n

The complaint lists the offense date as January 9, 2026.<\/p>\n

What the complaint says happened<\/h2>\n

The report says it happened at 7:56 a.m. on Highway 11 near 370th Avenue.<\/p>\n

A Roseau-area school bus was stopped to pick up children, according to the filing.<\/p>\n

The bus was eastbound and stopped at a driveway on the south side.<\/p>\n

Two children were outside the bus and near the steps, the driver reported.<\/p>\n

The bus driver, Bryan Palmer Olson, said he used amber lights before stopping.<\/p>\n

He said he then turned on red flashing lights and extended the stop arm.<\/p>\n

Olson said the warning distance was about a half mile.<\/p>\n

He said a semi-truck kept coming from the westbound lane.<\/p>\n

Olson said he sounded the bus horn as the truck approached.<\/p>\n

He said the truck braked only moments before passing the bus.<\/p>\n

He said the truck moved partly onto the shoulder.<\/p>\n

Olson estimated the passing speed at 30 to 40 mph.<\/p>\n

Witness account<\/h2>\n

A witness, Simone Suzette Erickson, said she brought her children to the stop.<\/p>\n

She said the semi came toward the bus at highway speed.<\/p>\n

She said it did not slow until it was next to the bus.<\/p>\n

Erickson estimated the semi was near 60 mph before braking.<\/p>\n

She described a silver semi pulling a low-boy trailer.<\/p>\n

She said a red tractor was on the trailer.<\/p>\n

Driver statement<\/h2>\n

A state trooper later located a similar semi on Highway 11, records say.<\/p>\n

The stop was near 130th Avenue, according to the complaint.<\/p>\n

The filing says Neustel admitted he passed a school bus.<\/p>\n

Neustel said he first thought he saw an oversized truck.<\/p>\n

He said he noticed amber lights that turned red.<\/p>\n

He said he then saw the bus stop sign extended.<\/p>\n

Neustel said he tried to brake but could not stop in time.<\/p>\n

He estimated his speed at about 40 mph.<\/p>\n

Law and penalties<\/h2>\n

Minnesota law requires drivers to stop for a bus stop arm and red lights.<\/p>\n

The rule is in Minnesota Statute 169.444<\/a>.<\/p>\n
