VALLEY CITY, N.D.<\/strong> (trfnews.i234.me<\/a>) \u2014 A Valley City man faces felony charges after an apartment call.
\nPolice say the case includes felony terrorizing and a drug allegation.
\nThe call came in early Saturday morning.<\/p>\n

Police say they were sent to an apartment building in the 1000 block of Fifth Street Southeast.
\nThe call came in around 5:28 a.m., according to a police report.
\nOfficers arrested Eugene Weston Smith<\/strong>, 33, of Valley City.<\/p>\n

What witnesses told police<\/h2>\n

Three people inside the apartment spoke with officers, police said.
\nThey reported that Smith showed a gun during the dispute.
\nThey said he pointed it at one of the women.<\/p>\n

The woman told police that Smith pulled the gun from behind his back.
\nShe said he cocked it and aimed it at her.
\nPolice say the woman told them she is pregnant.
\nShe said she feared for her life.<\/p>\n

Two other witnesses backed up her account, police said.
\nOfficers say they found a 9mm cartridge near the apartment doorway.
\nPolice later contacted Smith in a rear parking lot, the report says.<\/p>\n

Gun and ammo found<\/h2>\n

Smith denied having a gun, according to the report.
\nPolice say Smith claimed witnesses mistook a radio frequency meter for a gun.
\nOfficers say he stayed in his vehicle for about 15 minutes.<\/p>\n

Police say Smith called 911 to confirm the officers were real.
\nOfficers reported seeing a black handgun on the back seat.
\nThey then removed Smith from the vehicle, police said.<\/p>\n

Officers also found a loaded magazine in his pants pocket.
\nPolice say the ammunition matched the cartridge found outside.
\nOfficers recovered a Smith & Wesson SD9 VE<\/a> 9mm handgun.<\/p>\n

Police say the victim identified the gun as the one used in the threat.
\nSmith was taken to the Barnes County Correctional Center<\/a>.
\nPolice say jail staff found a small bag with a white crystal substance.<\/p>\n

Booking and court<\/h2>\n

Police say a field test showed the substance was methamphetamine.
\nPolice also cited a prior domestic violence conviction in Smith\u2019s history.
\nOfficers requested a prohibited-person gun charge, police said.<\/p>\n

Court records reviewed by TRF News say that the gun charge was dismissed.
\nSmith\u2019s next appearance is set for Feb. 26 at 1 p.m.
\nThe hearing is listed as a preliminary hearing and or arraignment.<\/p>\n

It is scheduled in Barnes County District Court before Judge Nicholas Thornton<\/strong>.
