Cass County, N.D.<\/strong> (trfnews.i234.me<\/a>) \u2014 A former Cass County sheriff\u2019s deputy will not serve jail time after an inmate slap.<\/p>\n

Sentence and court terms<\/h2>\n

Judge Stephannie Stiel ordered Andrew Wleh Robinson, 51, to complete 40 hours of community service.<\/p>\n

The case involves one misdemeanor count of simple assault.<\/p>\n

Robinson also must finish 360 days of unsupervised probation.<\/p>\n

If he meets the terms, the charge will be dismissed.<\/p>\n

The court will also seal the record, court files say.<\/p>\n

Robinson no longer lives in the Fargo-Moorhead area, his attorney told the court.<\/p>\n

What prosecutors said happened<\/h2>\n

Prosecutors said the assault happened on July 31, 2025, inside the Cass County Jail.<\/p>\n

They said Robinson slapped inmate Justin Hodge with an open hand.<\/p>\n

Court records said Hodge had a minor injury.<\/p>\n

He was treated at a local hospital.<\/p>\n

Prosecutors said they could not reach Hodge for input on the plea deal.<\/p>\n

Inmate account and case review<\/h2>\n

Hodge said the incident began during a cell release.<\/p>\n

He said a nearby door did not open.<\/p>\n

He said he tried to get staff attention.<\/p>\n

He said staff told him to return to his cell.<\/p>\n

Hodge said he argued that he had done nothing wrong.<\/p>\n

He said Robinson then slapped him.<\/p>\n

Hodge later said doctors treated him for a concussion.<\/p>\n

Agency response and prosecution change<\/h2>\n

The Cass County Sheriff\u2019s Office<\/a> placed Robinson on leave after the report.<\/p>\n

The agency later fired him, officials said.<\/p>\n

The North Dakota Bureau of Criminal Investigation reviewed the case.<\/p>\n

Records say it was referred for criminal charges.<\/p>\n

Cass County prosecutors stepped aside due to a conflict issue.<\/p>\n

Prosecutors from Grand Forks County handled the case instead, filings say.<\/p>\n

Plea deal details<\/h2>\n

Robinson reached a plea deal.<\/p>\n

He waived a court appearance on Tuesday, Feb. 17, 2026.<\/p>\n

His lawyer, Nichole Bredahl, entered the guilty plea for him.<\/p>\n

Bredahl told the court that Hodge used racial insults before the slap.<\/p>\n

Robinson is Black, and Hodge is white.<\/p>\n

Bredahl said Robinson was sorry for what happened.<\/p>\n

Stiel said the comments did not excuse the assault.<\/p>\n

She said officers are trained to stay calm.<\/p>\n
