Prosecutors filed two third-degree DWI counts in Kandiyohi County District Court.

What the police say happened

Officers were sent to 4th Street and Augusta Avenue SE after a crash report.

Dispatchers said the drivers were arguing, and one may have been intoxicated.

Police found a white Ford F-150 with a flat tire and a broken taillight, the complaint says.

A man later identified as Garcia was walking away from the truck, according to the complaint.

Garcia told police they did not need law enforcement, the complaint says.

He said the drivers would settle the damage with money.

Police reported an odor of alcohol on Garcia’s breath.

They also reported bloodshot, watery eyes.

Garcia told officers he was driving west on Augusta Avenue SE.

He said a northbound vehicle hit his truck, the complaint says.

Tests and alleged BAC

Police gave Garcia field sobriety tests at the scene, according to the complaint.

Officers reported signs of impairment during those tests.

The complaint says icy roads made some balance tests unsafe.

Garcia was arrested and taken to the law enforcement center, the complaint says.

A breath test later showed a reported alcohol concentration of 0.11, according to the complaint.

Charges filed in court

Prosecutors charged Garcia with two counts of third-degree DWI, both gross misdemeanors.

One count alleges driving with an alcohol concentration of 0.08 or higher.

The other count alleges driving under the influence of alcohol.

The complaint cites an aggravating factor and a prior impaired driving incident.

The filing notes a prior third-degree test refusal conviction dated February 6, 2023.

The current case was filed on February 18, 2026.

The case was filed by summons, not a warrant, court papers say.
