Nicole Mitchell’s felony burglary charge

The court hearing related to DFL Sen. Nicole Mitchell’s felony burglary charge, originally scheduled for July 1, has been postponed to July 9 in Becker County District Court. Mitchell seeks to dismiss the charges, claiming no intent to commit a crime during her April arrest at her stepmother’s Detroit Lakes home.

Mitchell’s defense filed for dismissal, arguing the absence of probable cause. They aim to present additional evidence, including her stepmother’s medical records and a forensic analysis of a computer allegedly stolen from the home, to support their case.

The case has been reassigned to Judge Doug Clark following a motion to remove the previous judge. Mitchell’s role as a pivotal vote in the evenly divided Minnesota Senate has sparked calls for her resignation from both Republican and DFL leaders.

Despite pressure, Mitchell maintains her innocence and refuses to step down, with an ethics complaint pending and further hearings scheduled for late July.
