West Fargo, ND (trfnews.i234.me) – A local family is calling for justice after they say a 16-year-old girl was violently attacked by an adult woman during a disturbing home invasion in West Fargo on July 10.

According to Kevin Hernandez of Dilworth, his niece had gone to a friend’s home around 12:50 a.m. when the assault occurred.

“A woman walked in, broke the fence, came into their home, and just attacked her,” said Hernandez.

The attacker, reportedly known to the family due to a previous dispute, is said to have punched, kicked, and even bitten the teen. She sustained a concussion and facial injuries, including two black eyes, a week after the incident.

“You took it upon yourself to not reach out to her mother. Instead, you go to this youngster’s house, kick in the fence door, walk right into the home, and jump on a 16-year-old girl… I mean, c’mon,” Hernandez said in disbelief.

The family reported the incident to the West Fargo Police Department, hoping for assault charges. Instead, they were told the only possible charge was breaking and entering — an explanation they find unacceptable.

“They said there’s no such thing as simple assault in West Fargo,” Hernandez added.

In a statement to TRF News, the West Fargo Police Department confirmed the incident is under active investigation, labeling it a “disturbance” with no further details at this time.

“This remains an ongoing and open investigation. No further information is available,” the statement read.

But for the Hernandez family, the lack of immediate arrest or assault charges feels like a failure of the system.

“If I were to bust into somebody’s home and assault someone, police would be all over it,” Hernandez said. “How many cases of adults assaulting children do you have where you can just brush it under the rug?”

The alleged attacker reportedly lives down the street in Dilworth, leaving the family on edge.

“The system is letting us down right now. The reluctance to even investigate this thing is beyond frustrating,” Hernandez said.

While the homeowner plans to pursue breaking and entering charges, the assault itself remains unaddressed, and the family is demanding accountability.
