Sentencing Delayed for Bismarck Man Convicted of Terrorizing with a Weapon

BISMARCK, ND (trfnews.i234.me) — Daedyn Lewellyn, a 19-year-old from Bismarck, had his sentencing hearing postponed after his defense attorney requested more time to review the pre-sentencing investigation (PSI) report. Lewellyn appeared in Burleigh County District Court on Monday, September 16, for the hearing after being convicted of terrorizing two people at their home last summer, as well as charges of reckless endangerment and failure to inform an officer of a concealed weapon.

During the proceedings, Judge James Hill agreed to delay the sentencing after Lewellyn’s lawyer revealed that they had only recently received the PSI report and had not had sufficient time to prepare. State law mandates a 14-day period for review of the PSI before sentencing can occur.

The case stems from an incident last summer when Lewellyn allegedly got into a heated argument with two people at their home and brandished a gun at one of them. He was later arrested by police near a U-Haul facility on Interstate Loop, where he was shot by a Bismarck Police Officer during the apprehension. Lewellyn was treated at a hospital for his injuries.

In an unusual turn of events, Judge Hill also granted Lewellyn’s request to dismiss his fifth attorney. Lewellyn has chosen to represent himself at his upcoming sentencing hearing, which has not yet been scheduled.
