The deputy wrote that the pickup crossed the centerline on a curve. The pickup then left the road, the complaint says.

Contact with the driver

The driver was still in the truck, the complaint says. Deputies identified him as Boe.

The deputy reported red, glassy eyes and an alcohol odor. The complaint says the weather and the location made testing hard.

Boe was taken to the Beltrami County Jail for field testing, the complaint says.

Breath tests and field tests

The complaint says Boe struggled to follow directions. The deputy reported swaying and poor balance.

A preliminary breath test showed 0.24 alcohol concentration, the complaint says. A later breath test showed 0.22.

Charge and bail

Prosecutors charged Boe with third-degree DWI. The count alleges 0.08 or more within two hours.

Under Minnesota law, third-degree DWI is a gross misdemeanor. The complaint lists one aggravating factor.

Judge Jeanine R. Brand set bail, the complaint says. Release was set at $0 with conditions.

Alternatively, bail was set at $12,000 without conditions. Future court dates are scheduled.
