Plummer Man Charged with .33 DWI in Marshall County
Marshall County ( trfnews.i234.me ) – A Plummer man is facing a gross misdemeanor DWI charge after law enforcement say he was found behind the wheel of a running vehicle with a blood alcohol level of .33 — more than four times the legal limit.
According to a criminal complaint filed in Marshall County District Court, 51-year-old Jason Wayne Malwitz was charged with second-degree driving while impaired, a gross misdemeanor under Minnesota Statute 169A.25. The charge carries a maximum penalty of one year in jail and a $3,000 fine.
Deputies with the Marshall County Sheriff’s Office were dispatched around 11:54 p.m. on October 11, 2025, after a report of a vehicle parked in the middle of State Highway 219 near 260th Street NE with its lights off. The caller described a silver or white SUV stopped in the roadway.
When the Deputy arrived, he found the vehicle with its lights flickering on and off, as if someone was attempting to start it. As the deputy parked behind the SUV, the lights went out completely. It was raining at the time, and the deputy noticed the driver’s side rear window was rolled down.
The deputy approached and saw a man sitting in the driver’s seat, later identified as Jason Malwitz. When questioned, Malwitz reportedly told the deputy he was “just going home” and pointed toward the direction of his door. When asked if he knew where he was, he sat silent before replying that he was from Plummer and had been “coming from home.”
The deputy observed slurred speech, bloodshot eyes, and balance issues as Malwitz exited the vehicle. He reportedly used the door for support and swayed while standing. Malwitz admitted to drinking but did not specify how much. Field sobriety tests showed multiple signs of impairment, including nystagmus in both eyes during the gaze test.
Due to knee pain, Malwitz was unable to complete balance-based tests. A roadside preliminary breath test could not be completed because of equipment malfunction, so Malwitz was arrested and transported to the Pennington County Jail for further testing.
At the jail, a breath test was administered twice, returning a result of .33 BAC. Due to the extremely high alcohol concentration, Malwitz was taken to Sanford Hospital for medical clearance before being booked into jail.
Court records show Malwitz has a prior DWI conviction from 2023, which contributed to the upgraded second-degree charge.
