Middle River man charged with criminal sexual conduct

A Middle River man has been charged in Marshall County District Court after he allegedly inappropriately touched a girl multiple times.

Calvin John Rybakowski, 50, has been charged with felony first degree criminal sexual conduct. He was arrested and remains incarcerated at the Pennington County Jail since the Marshall County Jail is being remodeled. The complaint was filed Monday, Sept. 9.

The charge stemmed from an Aug. 30 report that Rybakowski had allegedly inappropriately touched an 8-year-old girl while her family was staying at his home. Five days later, the Red River Children’s Advocacy Center conducted a forensic interview with the girl. According to the complaint, the girl allegedly said she awoke to Rybakowski inappropriately touching her and her underwear and pants had been pulled down. Rybakowski stopped touching the girl after she awoke. He then pretended to sleep. Since she didn’t want the activity to happen again, the girl went elsewhere to sleep in the home. The girl allegedly said such activity happened twice on Aug. 28 and many other times going back to when the girl was 6. She said she now doesn’t like Rybakowski. The girl later reported the incident to two women, who reported it to the sheriff’s office.

Rybakowski allegedly said one of the women reporting the incident was mad at him for blowing marijuana smoke into the girl’s face. He said he was high on marijuana laced with another drug and couldn’t remember anything that evening besides a storm. Rybakowski said he doesn’t remember anything after smoking marijuana.

The sergeant said Rybakowski inappropriately touched the girl, leading Rybakowski to allegedly say, “Oh, I did, I don’t remember anything.” He remembered falling on the girl, eating pizza and a storm that evening.

Rybakowski gave his marijuana to the sergeant since he said he didn’t want it anymore if it led him to inappropriately touch kids. He repeatedly said he
couldn’t remember anything from that night.

When asked, Rybakowski said he doesn’t think about younger girls and hasn’t engaged in such activity. Rybakowski said he hoped he didn’t inappropriately
touch the girl and he felt bad if he did. He tried to remember events of the evening, remembering events before and after what the girl had reported.

Rybakowski allegedly said he shouldn’t smoke marijuana because he possibly inappropriately touched the girl and repeatedly said he hoped he didn’t do it.
