Judge Declares Mistrial in Pembina County Rape Case

CAVALIER, ND (trfnews.i234.me) A Judge has ruled “mistrial” in the rape case against a Cavalier, North Dakota man. It remains to be seen whether or not the entire case will be dismissed.
a penmana County Judge Kerry agatnis has ruled a mistrial in the case against Kelly Jerome of cavalier Jerome was charged with gross sexual imposition in the alleged rape of a woman in July of 2021. the judge has ruled there was a discovery violation in the case basically the state’s attorney Rebecca Flanders did not give the defense all the evidence in the case that may have reflected favorably on Jerome’s innocence defense attorney Alec Reichert filed a motion saying in part a quote the trial of Kelly Jerome commenced on November 17 2022 before The Honorable Kerry agatnis in the late afternoon on the second day of the trial upon cross-examination of States witness Jane Doe the alleged victim it was discovered that Jane Doe had met with and given additional statements to the prosecutor the statements weren’t disclosed to the defense Council defense Council Alec Reichert made a motion for mistrial or in the alternative a continuance based upon the egregious Discovery violation unquote it now remains to be seen whether the judge rules whether it’s a mistrial with prejudice if that’s the ruling the entire case against Kelly Jerome would be thrown out as Double Jeopardy a person cannot be tried twice on the same charges meanwhile the prosecutor in the case States Attorney Rebecca Flanders lost re-election and is leaving her office a ruling of prejudice in this case could cast doubt on other cases prosecuted by Flanders we’ll keep you updated I’m the old Carlson reporting for itrfnews.i234.me
