Fargo, Cass County (trfnews.i234.me) — Fargo police are still sorting out a delayed shooting report from Jan. 24.

Investigators say the incident involved Odus Maxwell and Franklin Stewart Jr. The shooting was reported hours after it happened.

What the police reported

Police said a man arrived at a hospital with a gunshot wound. The injury was described as not life-threatening.

The man told officers he heard a “pop” while leaving a home. He said he then realized he had been shot.

A witness later told police the shooting happened inside a home. That home was in the 1500 block of 10th Street North.

Court documents list the address as 1530 10th Street North. Police served a search warrant that evening.

Police arrested Maxwell, 50, on suspicion of aggravated assault. Fargo police announced the arrest late that day.

Charge status on Feb. 1

As of Feb. 1, court records did not show an aggravated assault filing. Police have not said why.

Court records in the case show another charge moving forward. Maxwell is charged with unlawful possession of a firearm.

That firearm charge is tied to the same Jan. 24 investigation. The shooting case remains under review.

Second arrest in the case

Court documents show Franklin Stewart Jr. was later found at a Fargo Airbnb. Records say he was arrested three days later.

The arrest listed drug charges, including fentanyl. It also listed possession of drug paraphernalia.

Court records say Stewart had left the hospital before that arrest. His condition has not been detailed.

Past conviction in Grand Forks

Maxwell also has a serious record from Grand Forks. In 2016, he was convicted of attempted murder.

That case involved the shooting of David Gomez. It happened near the 1000 block of North 39th Street.

Court records show Maxwell received a six-year prison sentence. That case was separate from the Fargo investigation.
