Fargo Police responded to a domestic violence report at an apartment.
The victim, Upshawโs former live-in girlfriend, told officers they had been in an on-and-off relationship for four years.
The victim described a violent attack:
Upshaw grabbed her face and neck, causing scratches. He pushed her to the ground and dragged her back to the bedroom by her hair. He then grabbed her throat, crushing her esophagus and blocking her breathing for โwhat felt like minutes.โ
Upshawโs Statement & Arrest
Upshaw denied physically assaulting the victim, claiming they only had a verbal argument.
Upon searching Upshaw, officers found a marijuana vape pen, leading to an additional charge for possession of marijuana paraphernalia.
