Fargo, North Dakota (trfnews.i234.me) – A disturbing racial discrimination lawsuit has been filed in Hennepin County District Court by Xavier Davis, who says he and a friend were told to sit in the back of an empty Jefferson Lines bus in Fargo on July 13, 2023—simply because they are Black.

According to court documents, the driver, identified as Koby McFarlane, insisted the two men sit in the back, despite company policy stating seating is first-come, first-served. White passengers were not given the same instructions. The driver later claimed the men “smelled like marijuana,” which Davis’s legal team called a racially charged stereotype.

The Minnesota Department of Human Rights found probable cause for racial discrimination in January 2025.

In the lawsuit, Davis draws powerful parallels to Rosa Parks’ 1955 refusal to give up her bus seat, saying this modern-day incident reflects deeply rooted racial injustice. He is seeking over $50,000 in damages, potentially tripled, plus punitive and civil fines.

A trial could occur in late 2026.
