SAINT LOUIS PARK, Minn. (trfnews.i234.me) – Steven Bailey, whose blood alcohol level was four times the legal limit, will soon be released from jail on a conditional basis following a tragic crash at Park Tavern last month that left two people dead and nine others injured. The Hennepin County Attorney’s Office confirmed that Bailey had a long history of driving while intoxicated (DWI), with convictions dating back to 1985 in Wisconsin.

Bailey’s record includes four additional DWIs, and he has lost his driver’s license twice. Despite these past offenses, the conditional release will allow him to leave jail later this month and head directly to an alcohol treatment facility. He will also be required to wear an ankle bracelet that monitors his alcohol levels.

Thomas Gallagher, a criminal defense attorney familiar with DWI cases, explained the reasoning behind such decisions, noting that Minnesota’s Rules of Criminal Procedure have two main public policy objectives: ensuring the accused appears in court and protecting public safety.

“The condition of being released to alcohol treatment and wearing an ankle bracelet reflects the judge’s concern for public safety,” said Gallagher.

Attorney Michael Bryant noted a specific detail in the conditional release order: Bailey’s lawyer is required to personally escort him from jail to the treatment center. “This shows the judge carefully considered Bailey’s history,” said Bryant. “If he violates any part of the order, he will be sent back to jail and likely won’t be released again before trial.”

Bailey’s previous records show he complied with all court orders after his last arrest in 2014. However, the tragedy at Park Tavern has reignited concerns about repeat offenders and the effectiveness of past interventions.

“Overall, it’s a horrible, tragic situation, and the courts are trying to balance legal procedures with ensuring public safety,” added Bryant.

As Bailey prepares for his conditional release, legal experts emphasize that this is all part of the judicial process.
