Deputy clarifies details of recently enacted North Dakota gun law

GRAND FORKS, ND (trfnews.i234.me) North Dakota’s new, Constitutional Carry gun law went into effect today. Officers say it’s raising a lot of questions. Sgt. Andy Schneider of the Grand Forks County Sheriff’s Department explains it.
hey everyone Neil Berg here in gr forks with Sergeant Andy Schneider with the gr Forks County Sheriff’s Department it’s August 1st North Dakota has a new gun law can you kind of just go over what what that means basically anyone can have a gun if you’re law abiding uh more or less uh it’s called the Constitutional carry law and it allows persons who still meet the requirements required to possess a handgun to carry a concealed weapon on their person and obviously with some still with some restrictions and does that weapon is it supposed to be concealed or can I get a holster and put it on my hip right so part of the uh part of the laws covers what concealed carry is North Dakota is a concealed carry only state so if you’re carrying under the guise of concealed carry it must be concealed and what the con concealed carry law allows us to do is carry a loaded weapon concealed now we also have the uh the law that allows you to carry in plain view but that weapon must be unloaded okay so the law that went into effect today is that for the Constitutional carry yeah to allow persons to carry a concealed weapon okay you maybe un unholster your weapon here sure and there are some particulars also with that aren’t there so your weapon here I mean Can it have a clip in it or a bullet in the chamber under the Constitutional carry yeah yep so with constit constitutional care you can have a loaded magazine and a round in the chamber if it is sealed granted you’re carrying in places where you’re not prohibited and you’re a person that is not prohibited from carrying okay maybe I can get into this a little bit uh what about if I’m a a bar owner can I say I don’t want weapons in in my business or how does that work well private entities do have the right to refuse service correct and bars are one place that are restricted already from people carrying weapons including concealed carry holders okay so whether you have a concealed permit or or carrying under the new law you’re not supposed to have a weapon in a bar not in a bar not unless you’re the proprietor an employee of the proprietor uh it’s part of a raffle or a fundraiser something of that sort so you work in law enforcement what do you think of this you think it’s going to cause problems or not really well there’s clearly a lot of confusion uh there’s a lot of misinformed people that uh may or may not carry uh we’ve already received quite a few phone calls wondering if certain people can carry and it’s kind of concerning uh a gentleman called on behalf of his brother who currently has has a restraining order out against him and uh has also been in mental health treatment well both of those are part of restrictions for persons who cannot carry okay and he stated his brother was going to carry constitutionally and I clarified for him that his brother was not allowed to okay is there uh some place on the web people can go to answer a lot of these questions the North Dakota attorney general’s web page actually has a uh a link that provides you with all the information regarding the Constitutional carry what you can and cannot do and that’s what we’re talking today for August 1st correct yeah it goes into effect today yeah okay all right thanks for talking to me okay all right in downtown gram Forks I’m Neil Berg reporting for in trfnews.i234.me

  1. Please realize. Your Question was "Do you think it going to cause problems?"

    Illegally carrying a Gun is Illegally carrying a Gun. If someone is going to use a Gun and Rob you this is not giving THEM permission they are going to do what ever they want with or with out the law.

    Now, however if someone is going to carry a gun and rob you, YOU have the right to be armed to defend yourself, & the Illegally carrying guy that is going to Rob you KNOWS you might be Armed.

    Legalizing Law-abiding people to carry, is not going to cause any more problems than BANNING Law-abiding Citizens from carrying to Defend themselves.
    It Might however give Criminals reasons to rethink their choices. Like Only rob Gun Free Zones?!

  2. So if you don't have a CCW, and you are constitutionally carrying a concealed firearm, (not in a vehice).. are you allowed to have one in the chamber?
