What investigators say happened

The complaint says Swan told the deputy her license was canceled.

The status was listed as “inimical to public safety,” the complaint says.

The complaint ties that status to prior impaired driving cases.

The deputy noted Swan’s pupils looked very small.

The deputy also reported bloodshot, watery eyes.

The complaint says Swan showed signs of impairment.

She tried to count for 30 seconds.

The complaint says she reached 38 seconds.

A preliminary breath test showed 0.00 BAC, the complaint says.

Swan allegedly said she used fentanyl and methamphetamine two days earlier.

She also said she would test positive, the complaint says.

Investigators obtained a search warrant for a urine sample, the complaint says.

The warrant was approved and executed.

The complaint points to a prior case in Beltrami County.

Records indicate Swan was convicted of DWI on January 7, 2026.

That was less than three weeks before this stop, the complaint says.

Charges and next steps

Swan faces one felony count of drug DWI.

It alleges driving under the influence of a controlled substance.

She also faces a gross misdemeanor count for driving after cancellation.
