Cass County (trfnews.i234.me) — Two people from the Fargo–Moorhead area now face felony charges after an apartment garage incident in Fargo.

According to court documents, officers were sent to a Fargo apartment complex on November 23 at about 9:26 p.m. The call reported a garage burglary in progress.

A witness supplied video that showed a woman trying to get into several garage units, records say. Investigators later identified the woman as 33-year-old Lillian A. Morin of Moorhead.

Darby C. Smith of Dilworth and Lillian A. Morin of Moorhead are charged in the linked burglary and drug case.

Prosecutors say Morin tried to open or damage locked garage doors at the complex. No major property loss was listed in the complaint. However, the report says Morin had no right to enter the units.

Morin is now charged with two felony counts of attempted burglary. The charges accuse her of trying to enter the garages with the intent to commit a crime inside.

Police also contacted 35-year-old Darby C. Smith of Dilworth during the investigation, according to court records. Officers searched Smith and a vehicle tied to the case.

Records say officers found about 173 grams of suspected methamphetamine. Prosecutors allege the amount and packaging showed the drugs were meant for sale.

Smith is charged with possession with intent to deliver methamphetamine, a drug trafficking felony. The drug charge is filed in connection with the same attempted burglary case.

The case will move through Cass County District Court. Hearing dates and case numbers are expected to appear on the public court site at ndcourts.gov.

Methamphetamine remains a major concern for police and treatment workers in North Dakota. The U.S. Drug Enforcement Administration notes that meth can be highly addictive and dangerous. More information is posted on the DEA’s methamphetamine page at dea.gov.

Burglary and attempted burglary charges can bring prison time if there are convictions. North Dakota’s burglary laws are described in the state’s criminal code, which is available through the North Dakota Legislative Branch website at legis.nd.gov.

All charges against Darby C. Smith and Lillian A. Morin are accusations at this time. Both are presumed innocent unless a judge or jury finds them guilty in court.
