Prosecutors say the stop happened near County Road 7 and 460th Street in Clearwater County. A sheriff’s deputy reported the vehicle crossed the fog line several times. The complaint says Johnson had watery eyes and an odor of alcohol. The filing says he admitted to drinking three beers.
What police allege
Court records say officers tried to arrest Johnson for suspected impaired driving. The complaint says he pulled away and resisted. Prosecutors allege he struck a deputy in the face with a closed fist. The filing says the deputy suffered a nosebleed.
The complaint says a Bagley police officer then tried to use a Taser. Prosecutors allege Johnson grabbed the device and pulled it away. The filing says the Taser was deployed and shocked the officer’s hand. Officers later secured Johnson on the ground, the complaint says.
Charges and bail
Johnson is charged with felony disarming a peace officer and felony fourth-degree assault. He also faces second-degree DWI test refusal and obstructing legal process, according to the complaint.
Prosecutors say Johnson later refused a blood or urine test at the hospital. The filing says officers had a search warrant.
In Clearwater County District Court, Judge Eric Schieferdecker set bail at $100,000 with conditions. Bail was set at $200,000 without conditions, court records say.
The complaint also notes prior DWI convictions. It says Johnson is awaiting sentencing in another felony case.
