Fargo Man Accused of Drugging Women, Recording Assaults

FARGO, ND (trfnews.i234.me) – A 33-year-old Fargo man is facing numerous felony and misdemeanor charges after prosecutors allege he drugged and sexually assaulted two women in 2022, secretly recorded the encounters, and distributed at least one recording.

Jacob Steven Metcalf, 33, was named in an amended charging document filed in Cass County District Court. A warrant has been issued for his arrest, according to an October 21, 2026, report.

Prosecutors Allege Two Women Were Drugged

According to the charging document, the alleged offenses occurred between August and October 2022.

Prosecutors allege Metcalf administered intoxicants or controlled substances to two women without their knowledge to impair their ability to resist sexual activity.

The women are identified only by their initials in court records. Their identities are being withheld to protect their privacy.

Metcalf faces multiple counts of gross sexual imposition and sexual assault, including allegations involving serious bodily injury and victim impairment.

GHB and Clonazepam Named in Drug Allegations

The amended information also includes two counts of possession with intent to manufacture or deliver controlled substances.

According to prosecutors, the substances involved included GHB, a central nervous system depressant, and clonazepam, a prescription benzodiazepine.

Investigators allege Metcalf discussed providing drugs to other people to incapacitate them.

The charging document also describes an alleged statement in which Metcalf referred to using GHB to render another person unconscious.

Secret Recordings Allegedly Made Without Consent

Prosecutors allege Metcalf created or possessed multiple sexually expressive recordings of the two women without their knowledge or consent.

According to the filing, investigators identified eight recordings involving one woman and five involving the other.

Metcalf is also accused of distributing at least one recording with the intent to cause emotional harm or humiliation.

The recording-related allegations include 13 counts of creating or possessing surreptitiously created sexually expressive images and one count involving dissemination.

North Dakota law prohibits certain forms of nonconsensual creation, possession, and distribution of intimate images under North Dakota Century Code Section 12.1-27.1-03.3.

Class AA Felony Charges Carry Serious Penalties

The most serious charges are classified as Class AA felonies involving gross sexual imposition.

Under North Dakota Century Code Section 12.1-20-03, a qualifying Class AA felony gross sexual imposition conviction carries a mandatory minimum period of incarceration of five years, with additional sentencing requirements potentially applying depending on the offense.

Other allegations include Class A and Class B felonies, while the nonconsensual recording-related offenses are identified as Class A misdemeanors.

These are potential legal penalties and do not represent sentences imposed in Metcalf’s case.

Arrest Warrant Issued in Cass County

According to the report, authorities have issued an arrest warrant for Metcalf.

His custody status was not confirmed in the information available, and court records cited in the report did not establish that he had entered a plea.

The report also did not confirm whether Metcalf had retained an attorney.

The charges remain allegations. Metcalf is presumed innocent unless proven guilty in court.
