Deputies Find Driver Asleep in Running Car
Deputies arrived and found a Ford car stopped in the southbound traffic lane near a residence.
According to court documents, a deputy approached and saw Emineth asleep behind the steering wheel.
The car was in park, but its engine remained running.
The deputy reached through the open driver’s window and turned off the ignition.

A driver’s license check showed that Emineth was required to have an ignition interlock device.
However, deputies reported seeing no such device inside the vehicle.
Breath Test Shows 0.00
During the investigation, Emineth provided a preliminary breath test sample.
According to the complaint, the test showed an alcohol reading of 0.00.
Emineth reportedly told deputies he had taken prescribed gabapentin earlier that day.
He also reportedly admitted smoking marijuana earlier in the day.

What Is an Ignition Interlock Device?
An ignition interlock device requires a driver to provide a breath sample before starting a vehicle.
The system helps enforce driving restrictions connected to certain alcohol-related offenses.
Minnesota law requires some drivers to use these devices when operating vehicles under restricted driving privileges.
Drivers subject to these restrictions must follow the conditions of their licenses.
Gross Misdemeanor Charge Filed
Emineth faces one gross misdemeanor charge under Minnesota Statute 171.09, subdivision 1(g).
The charge alleges he operated a vehicle without the required ignition interlock device.
The complaint lists a maximum penalty of 364 days in jail, a $3,000 fine, or both.
Court documents also identify two earlier DWI convictions in Emineth’s criminal history.
Those convictions are separate from the current charge.
