Alvarado: Toscano Cardenas Faces Knife Assault
ALVARADO, Minn. (trfnews.i234.me) — Daniel Ivan Toscano Cardenas faces a felony assault charge following an alleged knife incident.
The case was filed in Marshall County District Court.
Toscano Cardenas, 45, is charged in court file 45-CR-26-259.
The alleged incident happened Aug. 23, 2026, at a residence in Alvarado.
Knife Allegedly Displayed During Argument
The criminal complaint says law enforcement responded to a reported assault involving a knife.
A woman at the residence told investigators Toscano Cardenas had been drinking and arguing with her.
She alleged he picked up a knife during the disagreement.
The complaint says Toscano Cardenas then began walking toward her while holding the knife.
She reportedly became frightened and ran outside.
According to prosecutors, Toscano Cardenas then dropped the knife.
The woman told investigators she believed he might have used the knife against her.
She also reported feeling afraid during earlier incidents at the residence.
No police officer names are included in this report.
Toscano Cardenas Denied Threatening Woman
Investigators later contacted Toscano Cardenas at another nearby residence.
He was taken into custody without incident, according to the complaint.
The complaint says a preliminary breath test later produced a reading of 0.265.
He was taken for medical clearance before returning to the Marshall County Jail.
During an interview, Toscano Cardenas denied holding a knife.
He also denied trying to threaten or frighten the woman.
Investigators later returned to the residence for additional information.
The woman again alleged Toscano Cardenas walked toward her while waving the knife.
Police seized a knife identified as the one allegedly involved.
Felony Assault Charge Filed
Prosecutors charged Toscano Cardenas with second-degree assault involving a dangerous weapon.
The charge cites Minnesota Statute 609.222, subdivision 1.
The offense is a felony under Minnesota law.
A conviction can carry up to seven years in prison.
A fine of up to $14,000 is also possible.
Those are maximum penalties and do not represent a sentence.
Charge Remains an Allegation
The criminal complaint contains allegations that have not been proven in court.
Toscano Cardenas is presumed innocent unless proven guilty beyond a reasonable doubt.
