Moorhead I-94 Gun Display Leads to Felony Charge

Moorhead (trfnews.i234.me) — David Allan Kruse faces two charges after a reported confrontation on Interstate 94 in Clay County.

Prosecutors charged Kruse with felony second-degree assault involving a dangerous weapon.

He also faces a gross misdemeanor charge for allegedly carrying a pistol without a permit.

The incident happened on August 19, 2026, according to a Clay County criminal complaint.

Driver Reports Gun Display on I-94

Authorities received the report around 5:38 p.m. on eastbound Interstate 94.

The incident was reported near mileposts eight and nine in Clay County.

Another driver reported traveling behind a silver Cadillac SUV.

The driver said the Cadillac was traveling below the speed limit in the left lane.

He alleged the Cadillac then brake-checked his vehicle as traffic backed up.

The other driver responded by making an obscene hand gesture, according to the complaint.

He then reported seeing the Cadillac driver display a black handgun.

The driver told authorities that he felt threatened by the alleged display.

Authorities continued receiving location information as the Cadillac traveled through Clay County.

The vehicle eventually left the interstate and traveled toward Clay County Road 10.

Law enforcement later stopped the Cadillac and identified David Allan Kruse as the driver.

Kruse acknowledged that an incident had occurred on Interstate 94, according to the complaint.

He said the other vehicle had followed him at an unsafe distance.

Kruse said he eventually moved right so the other driver could pass.

He told investigators that the other driver then made an obscene gesture toward him.

Kruse admitted displaying his handgun, according to prosecutors.

However, Kruse denied pointing the gun at the other driver.

He said the weapon was pointed straight ahead.

Kruse said he displayed it to show that he could defend himself.

Authorities recovered a black handgun from Kruse’s vehicle, according to the complaint.

The magazine contained ammunition when investigators removed it.

Kruse allegedly told authorities that he did not believe his carry permit was valid.

Investigators reported that Kruse did not have a valid Minnesota permit to carry.

The permit law is available under Minnesota Statute 624.714.

Second-degree assault with a dangerous weapon is a felony under Minnesota law.

The charge carries up to seven years in prison and a $14,000 fine.

The assault statute is available under Minnesota Statute 609.222.

The weapons count carries up to 364 days in jail and a $3,000 fine.

The case is filed as State of Minnesota v. David Allan Kruse.

The court file number is 14-CR-26-3003 in Minnesota’s Seventh Judicial District.
