ALVARADO, Minn. (trfnews.i234.me) — A Warren woman faces two gross misdemeanor charges following a rollover near Alvarado.

Court records allege two children were inside the vehicle during the September 25 crash.

Jade Alexis Fish is charged with third-degree driving while impaired and child neglect.

The charges were filed in Marshall County District Court. The case number is 45-CR-24-280.

Vehicle Rolled Near Alvarado

Emergency crews responded shortly after 10 p.m. to Minnesota Highway 1, east of Alvarado.

They found a silver Chevrolet Impala in the south ditch. The vehicle had extensive rear damage.

The complaint states the car entered the ditch sharply. It then turned sideways and rolled several times.

Fish told investigators she swerved to avoid a deer. Investigators reported slurred speech and watery eyes.

They also reported smelling alcohol. Fish admitted drinking one beer and a vodka beverage, the complaint states.

Two children under the age of 16 were riding in the car. Both were taken for medical checks.

The children appeared uninjured, according to the complaint. All three occupants had reportedly worn seatbelts.

Blood Test Reported at .116

Fish complained of shoulder pain after the crash. X-rays found no separated shoulder.

Medical staff diagnosed contusions, according to the court filing. Standard roadside testing was not completed.

An investigator later obtained a search warrant for a blood sample. The sample was sent for laboratory testing.

The test later showed a blood-alcohol concentration of .116, according to the complaint.

Minnesota law sets the standard driving limit at .08.

The complaint lists the children’s presence as an aggravating factor in the DWI charge.

Two Gross Misdemeanor Charges

Fish faces third-degree DWI under Minnesota Statute 169A.26.

That charge carries a maximum penalty of one year in jail and a $3,000 fine.

She also faces child neglect under Minnesota Statute 609.378.

That charge carries the same maximum jail term and fine.

Fish had no prior DWI convictions listed in the complaint. She was released while investigators awaited test results.

Charges in a criminal complaint are allegations. Fish is presumed innocent unless proven guilty in court.
