Bemidji Woman Charged In High-BAC DWI Case

Bemidji (trfnews.i234.me) — A Bemidji woman is facing a gross misdemeanor DWI charge after a late-night traffic stop in Beltrami County.

Tori Misty Myslajek has been charged in Beltrami County District Court. The charge alleges she operated a motor vehicle with an alcohol concentration of 0.08 or higher within two hours of driving.

The case was filed under court file number 04-CR-26-1225. The alleged offense happened on May 29, 2026, in the City of Bemidji.

Traffic Stop On Paul Bunyan Drive

According to the criminal complaint, a Minnesota State Patrol trooper stopped a vehicle around 1:12 a.m. The stop happened near the 200 block of Paul Bunyan Drive South.

The complaint says the vehicle had no front license plate. It also had dark window tint, according to court records. A suspended object was also seen hanging from the rear-view mirror.

Myslajek was identified as the driver and sole occupant of the vehicle.

Authorities said the trooper noticed a strong perfume-like smell during the stop. The complaint also says Myslajek had bloodshot, watery eyes and droopy eyelids.

Breath Test Allegations

The complaint says Myslajek told authorities she worked at a local hospital. She said she finished her shift around midnight.

She also said she left her hotel about ten minutes before the stop. She first denied drinking alcohol or taking medication before driving.

Authorities asked Myslajek to perform field sobriety tests. The complaint says she did not perform the tests satisfactorily.

After the tests, Myslajek allegedly said she had a glass of wine earlier that night. She again denied using medication.

A preliminary breath test reportedly showed a result of 0.267. Myslajek was then arrested and taken to the Beltrami County Jail.

Authorities later requested a breath sample after reading the breath test advisory. Court documents say Myslajek agreed to testing.

The DataMaster breath test reportedly showed a result of 0.24 at 2:09 a.m.

Charge And Court Status

The charge is listed as a gross misdemeanor under Minnesota Statute 169A.20.

The maximum penalty is 364 days in jail and a $3,000 fine. Court records list aggravating factors in the case.

The complaint says Myslajek had no Minnesota alcohol-related criminal history. However, her driving record lists two prior Connecticut convictions.

Those convictions involved driving with a blood alcohol concentration at or over 0.08. The conviction dates were July 28, 2010, and January 21, 2014.

A criminal complaint is not a conviction. Myslajek is presumed innocent unless proven guilty in court.
