THIEF RIVER FALLS (trfnews.i234.me) — A Thief River Falls man is facing a felony DWI charge after police say he drove home intoxicated from a local bowling alley and bar.
According to court documents, Joshua Lee Fain, 44, has been charged with second-degree driving while impaired – two or more aggravating factors following an incident on the evening of October 23.
Police were called around 9 p.m. to SouthTown Lanes, Pizza & Pub for a report of an individual having a seizure. The complaint stated that Fain had been drinking heavily, refused assistance from others, and then left the location in his vehicle.
A responding officer later located Fain’s vehicle parked outside his residence at 1201 Greenhill Drive. The car’s taillights were on, and Fain was seen standing at the front door. Officers determined his driver’s license had been revoked.
When questioned, Fain told police that seizures were not uncommon for him and declined medical attention. When asked why he had driven despite not having a valid license, Fain allegedly replied that he “had to get home.”
The officer noted signs of intoxication, and Fain failed multiple field sobriety tests. A preliminary breath test showed a blood alcohol content of 0.241. The officer also inspected the vehicle and found the hood still warm, indicating recent use.
At the Law Enforcement Center, Fain provided a breath sample using a DMT device, which again registered a 0.241 BAC. The complaint further stated that Fain had a prior DWI conviction within the past ten years.
Fain was arrested and booked into the Pennington County Jail. If convicted, he faces enhanced penalties due to his prior offense and the high blood alcohol concentration.
